Customer alleges pest control business caused chemical exposure

GALVESTON  — A customer is suing a La Marque pest control business, alleging its negligence cause her to become ill.

Tina Martino filed a lawsuit March 21 in Galveston County District Court against Roger Schrull doing business as A-1 Guaranteed Pest Control + Termites, and dentist Charles Harris, alleging design defect, negligence, negligence resulting in injury and product liability.

According to the complaint, between July 2014 and 2015, Martino experienced several symptoms of chemical exposure when she accidentally inhaled chemicals used for bugs at Harris' dental office in La Marque. The plaintiff says the defendants sprayed chemicals, which was only meant to be used outdoors, all over the building floor, causing symptoms of chemical exposure to Martino.

Martino seeks a trial by jury, monetary relief of more than $1 million, all damages, interest at the maximum rate allowed by the law, all legal fees and any other relief the court deems just. She is represented by attorneys Joshua Estes and James L. Magers of The Estes Law Firm PC in Richmond.
