Harris County customer accuses car dealership of fraud

GALVESTON —  A Houston customer is suing a Texas car dealership, alleging breach of contract and fraud.

Irvin Williams of Houston filed a lawsuit March 30 in the Galveston County District Court against Benchmark Auto Sales, alleging it provided fraudulent misinterpretations about the circumstances of the plaintiff's warranty.

According to the complaint, on Dec. 20, 2014, Williams suffered monetary damages because his car's extended warranty was not initially applied when he purchased the vehicle. Thus, the suit said, the plaintiff had to pay for every service needed for his vehicle. 

The plaintiff alleges Benchmark made false representations that Williams' newly purchased vehicle would include an extended warranty when it did not. The suit says the defendant was not authorized to sell the warranty in the first place and failed to refund the money that the plaintiff paid for the warranty.

Williams seeks trial by jury, actual damages, treble and exemplary damages plus interest, all legal fees and any other relief the court deems just. He is represented by attorney Joseph K. Plumbar of Law Offices of Joseph K. Plumbar in Houston.
