Houston worker alleges ad agency failed to pay overtime

HOUSTON — A Houston worker is suing an advertising agency, alleging failure to pay overtime wages. 

Michael McDermott filed a lawsuit April 22, in the Houston Division of the Southern District of Texas against Wal LLC, doing business as Great Results LTD in Houston, and Marshall Williams, alleging violation of the Fair Labor Standards Act in failing to fairly compensate employees.

According to the complaint, between June 1, 2009, and Feb. 10, 2016, McDermott worked for more than 40 hours in multiple weeks but was not paid any overtime wage. The plaintiff alleges the defendants paid McDermott his hourly rate for all hours worked instead of the additional time and a half premium for his overtime hours. 

McDermott seeks a trial by jury, unpaid overtime wages, liquidated damages equal to the unpaid wage, interest, all legal fees and any other relief the court deems just. He is represented by attorneys Thomas H. Padgett Jr., Daniel B. Ross and Charles Scalise of Ross Law Group in Bellaire.
