Worker accuses hotel owners of not paying overtime

MARSHALL — A Texas hotel worker is suing a Tyler hotel business, alleging violation of overtime work rules.

Donna Renee Smith, individually and on behalf of all others similarly situated, filed a class action lawsuit May 11 in the Marshall Division of the Eastern District of Texas against Woodspring Hotels, LLC and Woodspring Hotels Property Management LLC, alleging violation of the Fair Labor Standards Act in failing to fairly compensate employees.

According to the complaint, between October 2013 and February 2016, Smith often worked more than 40 hours per week but was not paid any overtime compensation. The plaintiff alleges the defendants failed to pay any employees proper overtime wages for all time worked of more than 40 hours per week.

Smith seeks all unpaid back wages, liquidated damages equal to the amount of unpaid compensation, interest at the highest allowable rate, all legal fees and any other relief the court deems just. She is represented by attorney Shane McGuire of The McGuire Firm PC in Tyler.
