Employee accuses exterminator of failing to pay overtime

HOUSTON — An employee is suing a Harris County exterminator, alleging failure to pay overtime.

Marc Barentine filed a May 17 in the Houston Division of the Southern District of Texas against Southwest Exterminating Co. and Nicholas Spillios Jr., alleging violation of applicable minimum wage laws and violation of workers compensation acts in failing to fairly compensate employees.

According to the complaint, between April 19, 2014 and Feb. 5, 2016, Barentine worked as a technician for more than 40 hours a week without receiving any overtime pay. The plaintiff alleges the defendants failed to pay overtime compensation at the legal rate defined by the Fair Labor Standards Act, even when Barentine worked as much as 72 hours a week.

Barentine seeks a trial by jury, unpaid back wages at the applicable rate, judgment equal to the amount of minimum wage for every hour worked, liquidated damages, interest, all legal fees and any other relief the court deems just. He is represented by attorney Thomas H. Padgett Jr. of Ross Law Group in Bellaire.
