HOUSTON — An employee is suing a food commissary business, alleging it failed to pay employees proper overtime wages.
Elda Villagomez Garcia filed a class action lawsuit, individually and on behalf of all others similarly situated employees May 25 in the Houston Division of the Southern District of Texas against Diana's Commissary Food Services Inc., Alba Alvarez and Oscar Blanco, alleging violation of the Fair Labor Standards Act in failing to fairly compensate employees.
According to the complaint, between May 15-Oct. 20, 2015, Garcia worked as a food server on a food truck owned by the defendants for more than 40 hours per week but was not paid any overtime compensation. The plaintiff alleges the defendants failed to pay employees overtime wages as required by FLSA.
Garcia seeks a trial by jury, unpaid minimum wages and overtime wages, liquidated damages, interest, all legal fees and any other relief the court deems just. She is represented by attorneys Josef F. Buenker and Vijay A. Pattisapu of Buenker Law Firm in Houston.
