GALVESTON — An employee is suing a Pearland heat and air conditioning business, alleging refusal to pay overtime wages.
David Sandling of Brazoria County filed a lawsuit May 27 in the Galveston Division of the Southern District of Texas against Kenneth Kneeland and Kneeland A/C & Heat Inc., alleging violation of applicable minimum wage laws and violation of workers compensation acts in failing to fairly compensate an employee.
According to the complaint, between April-Dec. 21, 2015, Sandling worked for Kneeland as an electrical project manager and estimator for more than 40 hours a given work week but was not paid any overtime wages. The plaintiff alleges the defendants failed to pay overtime wages at the Fair Labor Standards Act applicable rate of time and a half for more than 40 hours of work per week.
Sandling seeks a trial by jury, damages plus interest, $12,000 for unpaid regular wages, $16,875 for unpaid overtime wages, $28,875 for statutory damage, $12,000 for actual damages, $200,000 for exemplary damages, all legal fees and any other relief the court deems just. He is represented by attorney Robert A. Whitley of Houston.
