Trinidadian worker accuses UPS of racial, age discrimination

HOUSTON — A black Fort Bend County man is suing United Parcel Services, alleging age discrimination, a hostile work environment and racial discrimination.

HOUSTON — A black Fort Bend County man is suing United Parcel Services, alleging age discrimination, a hostile work environment and racial discrimination.

Marcus Hackett, a black Trinidadian in his 50s with a college degree, filed a lawsuit June 23 in the Houston Division of the Southern District of Texas against United Parcel Services alleging violation of the 1964 Civil Rights Act and the Age Discrimination in Employment Act.

According to the complaint, in June 2008, Hackett began being subjected to a hostile work environment because of his race, religion, national origin and age and was denied promotional opportunities. As a result, the suit says, he has suffered grievous harm, including, but not limited to, substantial loss of income, humiliation and embarrassment, and a damaged credibility. 

The plaintiff alleges UPS retaliated and discriminated against him by falsely accusing him of wrongdoing, re-assigning him out of his department, demoting and removing him from acting manager and promoted a young woman with no college education. He now reports to her, the lawsuit states.

Hackett seeks a trial by jury, actual damages, back pay, front pay, pre and post-judgment interest, punitive damages, attorney fees, legal costs and other relief to which he is justly entitled. He is represented by attorney Ellen Sprovach of Rosenberg Sprovach in Houston.
