Consumer accuses financing company of deceptive practices

GALVESTON — A Galveston County man is suing a financing company, alleging unfair debt collection practices and deceptive trade practices.

Jaime Flores filed a lawsuit June 30 in Galveston County District Court against American Honda Finance Corp., doing business as Honda Financial Services, alleging violation of the Texas Business and Commerce Code.

According to the complaint, on Aug. 29, 2014, Flores was involved in a vehicular accident, injured and hospitalized, and his vehicle was towed to a storage facility. On Nov. 5, 2014, the suit says, Flores was informed Honda Financial had assessed a repossession fee and other costs and that these amounts were paid out of the proceeds of his claims with Travelers Insurance. 

The lawsuit states the defendant maliciously reported the repossession to a number of credit agencies, adversely affecting Flroes' purchasing power, credit history and credit ratings. As a result of the repossession, he has also suffered mental anguish. 

Flores alleges the defendant took possession of the car when he had not defaulted on payments, required him to pay repossession fees and costs in order to recover his vehicle, and reported the repossession to credit reporting agencies.

Flores seeks a trial by jury, monetary relief up to $100,000, all damages, pre- and post-judgment interest, attorney fees, legal costs and all other relief to which he is entitled. He is represented by Jose Garza, Martin Golando and Michael Moran of Garza Golando Moran PLLC in San Antonio, and Neil G. Baron of Dickinson.
