Surviving relatives accuse GM of manufacturing defect

SHERMAN — Surviving relatives of a man killed in a vehicle crash are suing General Motors, alleging it manufactured a defective occupant restraint system. 

Jose Melchor, as heir to the estate of Porfirio Melchor, Leonor Melchor, Maria Rosalba Melchor, Esther Melchor, Artemio Melchor, Maria Guadalupe Rodriguez and Christina Rangel, filed a lawsuit July 25 in the Sherman Division of the Eastern District of Texas against General Motors LLC, alleging defective manufacturing. 

According to the complaint, on June 23, 2015, Porfirio Melchor was a driving a 2010 Chevrolet Colorado pickup truck when he was involved in a motor vehicle accident on Interstate Highway 77 in Denton County. The suit says the vehicle's seatback failed, causing Melchor to suffer severe and incapacitating injuries, which contributed to his death July 4, 2015. 

The plaintiffs allege GM failed to provide sufficient warnings regarding the performance or malfunctioning of the driver's seatback, conducted inadequate testing as to the safety of the seatback, and failed to provide adequate occupant restraint system.

The plaintiffs seek trial by jury, judgment to be determined by the court for all damages, pre- and post-judgment interest, costs of court and any relief to which they are justly entitled.
