BEAUMONT — A Jefferson County man is suing a tea and coffee importer, alleging violation of federal overtime regulations.
Josh Weekly filed a class action lawsuit, individually and on behalf of all others similarly situated July 25 in the Beaumont Division of the Eastern District of Texas against Tortorice & Brady, Inc., doing business as Tea & Coffee America, alleging violations of the Fair Labor Standards Act.
According to the complaint, Weekly regularly worked more than 40 hours per week as a warehouseman from April to the present without being paid proper overtime compensation.
The plaintiff alleges a Tea & Coffee America failed to maintain accurate time and pay records and failed to pay him the overtime premium at a rate not less than one and one-half times his regular rate as required by FLSA.
Weekly seeks a trial by jury, all unpaid overtime wages, liquidated damages, attorney fees and legal costs, pre- and post-judgment interest and such other relief to which he is entitled. He is represented by attorneys Melissa Moore and Curt Hesse of Moore & Associates in Houston.
