Plaintiff Charlene Odom Garsee filed suit against Texas Farmers County Mutual Insurance on July 30, 2012.
According to the original petition, on Oct. 24, 2006, Garsee was operating a motor vehicle in Jefferson County in a safe manner when she was involved in a collision with a vehicle owned and operated by Mark Harvard.
Garsee accused Harvard of several acts of negligence, including failing to maintain control of his vehicle and keep a safe distance.
At the time of the collision, Texas Farmers insured Garsee. She contended she was entitled to underinsured motorist benefits, for which she made a claim for under her policy but was denied.
At trial, jurors were asked what sum of money would fairly compensate Garsee, awarding $22,000 for pain and mental anguish, $53,000 for impairment, $35,000 for lost earnings and $40,000 for medical expenses, according to the charge of the court, filed Aug. 9.
The trial began on Aug. 8.
