Houston luxury property realtor alleges competitor violated copyright law

HOUSTON — A Houston property realtor is suing another local real estate business, alleging copyright infringement and unjust enrichment.

JMMJ Resources LLC, doing business as Smarte Plans filed a lawsuit Aug. 4 in the Houston Division of the Southern District of Texas against John Daugherty Real Estate, Inc. alleging violation of the U.S. Copyright Act.

According to the complaint, JMMJ Resources has suffered and will continue to suffer financial damages and irreparable harm, for which there is no adequate remedy at law. The plaintiff alleges John Daugherty Real Estate copied JMMJ Resources' copyrighted work titled “3741 Meadow Lake Lane” without obtaining permission or license from the copyright holder.

JMMJ Resources seeks a trial by jury, injunctive relief enjoining the defendant from continuing its unlawful practices, monetary damages, including lost profits and benefits received by the defendant as a result of its actions, plus all other relief to which it is entitled. It is represented by attorney W. Shawn Staples of Stanley Frank & Rose in Houston.
