Western Airways alleges Houston energy company owes $9,000

Late 07

HOUSTON — Western Airways is suing a Houston energy company, alleging the defendant owes more than $9,000.

Western Airways Inc. filed a lawsuit Aug. 5 in Harris County District Court against Nopal Group, alleging breach of contract and unjust enrichment.

According to the complaint, on Feb. 11, 2008, Western Airways entered into a contract with Nopal to provide air transportation and other related services in the amount of $10,159.59. The suit says Western was able to receive partial payment totaling $1,000.

However, the lawsuit states, no additional payments have been made, causing the plaintiff to suffer monetary losses amounting to $9,159.59. The plaintiff alleges Nopal Group continues to refuse to pay the remaining amount due.

Western Airways seeks trial by jury, damages of $9,159.59, plus pre- and post-judgment interest, attorney fees, court costs and all other relief to which it is justly entitled. It is represented by attorney Christopher L. Ashby of Houston.
