Gregg County worker alleges employers failed to pay overtime

TYLER — A Gregg County man is suing multiple employers, alleging failure to pay overtime in violation of workers compensation acts.

Ryan McNeal filed a class action lawsuit, individually and on behalf of all others similarly situated, Aug. 25, in the Tyler Division of the Eastern District of Texas against Markum Enterprises LLC, doing business as Floor Removal King and Flood Out Restoration, McWhiney & Markum LLC, doing business as Floor Removal King and Flood Out Restoration and Wesley G. Markum, alleging violation of the Fair Labor Standards Act.

According to the complaint, from February 2016 to the present, McNeal performed general labor for the defendants, working more than 40 hours in at least one week without overtime compensation. The plaintiff alleges the defendants failed to pay him one and one-half times his regular rate for all hours worked more than 40 per week as required by FLSA.

McNeal seeks trial by jury, all unpaid overtime wages, liquidated damages, pre-judgment interest, attorney fees, court costs, and all other relief. He is represented by attorney Josh Sanford of Sanford Law Firm PLLC in Little Rock, Arkansas.
