GALVESTON — A Harris County woman is suing a health care employee, alleging he recorded her changing out of her hospital gown.
Jacqueline Garcia filed a lawsuit Sept. 13 in Galveston County District Court against Pedro Ortiz, alleging invasion of privacy.
According to the complaint, on July 16, 2015, Ortiz concealed his smartphone in a room at St. Luke's Diagnostic Center to record Garcia changing out of her hospital gown after she underwent an MRI. The suit says this act caused Garcia to suffer embarrassment, mental anguish, shame and humiliation.
The plaintiff alleges Ortiz wrongfully intruded into Garcia's private activities and maliciously disregarded her health, safety and rights.
Garcia seeks trial by jury, monetary relief of more than $1 million, plus interest, court costs, pre- and post-judgment interest, and all other relief. She is represented by attorneys Brian S. Humphrey II and Kelly M. Woods of Abraham, Watkins, Nichols, Sorrels, Agosto & Friend in Houston.
