BEAUMONT — A Port Arthur woman is suing a retail store operator, alleging the defendant's negligence led to the plaintiff falling and suffering injuries.
Dana McKinley filed a lawsuit Oct. 7 in Jefferson County District Court against Dolgen Corp. of Texas Inc. alleging the defendant breached its duty to use ordinary care to protect and safeguard its invitees.
According to the complaint, on Sept. 20, 2014, McKinley was a customer at defendant's store, commonly known as Dollar General, at College Street in Beaumont, when she fell over a debris left in the aisle by one of defendant's employees.
The suit says the fall resulted in severe injuries to McKinley's neck, back, left knee and a left toe that required medical expenses. The plaintiff alleges the defendant failed to keep its premises in a reasonably safe condition and failed to inspect its premises to discover latent defects and to make it safe.
McKinley seeks trial by jury, monetary relief between $200,000 and $1 million, plus interest, costs of suit and all other relief to which she is justly entitled. She is represented by attorneys Jonathan C. Juhan and J.J. Bragg of Beaumont.
