Taiwanese corporation alleges multiple defendants failed to pay for industrial crane

HOUSTON — A Taiwanese corporation and an individual are suing multiple defendants, alleging failure to deliver an industrial crane.

Jiayan Lifting Co. Ltd. and Sino Wang filed a lawsuit Sept. 13 in the Houston Division of the Southern District of Texas against Ramz LLC, Manzar Syed, also known as Syed Khudadad, and Arshad A. Bhatti, alleging they breached their contractual obligations.

According to the complaint, on Nov. 4, 2014, Jiayan Lifting and Wang entered a sales and purchase agreement with the defendants for the sale of a used Demag AC80-1 industrial crane for 205,000 Euros. The suit says the defendants' breach of contract caused the plaintiffs to suffer monetary damages of 102,135 Euros for not receiving the crane. 

The plaintiffs allege the defendants acted in concert to offer for sale the crane, said the the crane was in Italy near Milan, failed to deliver the subject crane and failed to return the money paid.

The plaintiffs seek trial by jury, actual damages of 102,135 Euros, plus travel expenses to inspect the crane, prejudgment interest, expenses, court costs, attorney fees and all other relief. They are represented by attorney Sean N. Hsu of Hartline Dacus Barger Dreyer LLP in Dallas.
