Driver alleges trucking company failed to pay overtime

HOUSTON — A Harris County truck driver is suing a trucking company, alleging violation of workers compensation acts in failing to pay overtime wages.

Demond Jones filed a class action complaint, individually and on behalf of all others similarly situated, Sept. 19 in the Houston Division of the Southern District of Texas against DAS Trucking LLC, alleging violation of the Fair Labor Standards Act.

According to the complaint, during the three-year period of Jones' employment prior to filing this complaint, he worked more than 40 hours a week but was not paid an overtime premium. The plaintiff alleges DAS Trucking failed to pay time and one-half times Jones' regular rate of pay for each hour worked more than 40 per week as required by FLSA.

Jones seeks trial by jury, unpaid wages, liquidated damages, attorney fees, litigation expenses, costs of court, pre- and post-judgment interest and all other relief. He is represented by attorney Charles M. R. Vethan of The Vethan Law Firm PC in Houston.
