HOUSTON — A Brazoria County woman is suing legal services providers, alleging breach of fiduciary duty.
Tiffany Smith, individually and on behalf of her minor son, Brett Garcia, filed a lawsuit Sept. 22 in Harris County District Court against
Angelica M. Chavez, Juan C. Rodriguez and Law Offices of Juan C. Rodriguez PLLC,
alleging negligent representation.
According to the complaint, the defendants' actions, in a case involving a March 2013 vehicle crash that injured Smith and Garcia, caused Smith to suffer economic damages, money she would have recovered and collected had the suit been properly filed. The suit says Smith also suffered mental anguish and exemplary damages resulting from gross negligence.
The plaintiff alleges the defendants failed to timely file the lawsuit, misrepresented the limitations' expiration date, mishandled the insurance claim and terminated representation too close to the limitation expiration date.
Smith seeks trial by jury, monetary relief of more than $1 million, pre- and post-judgment interest, court costs and all other relief. She is represented by attorney Benjamin K. Sanchez of Sanchez Law Firm in Houston.
