Consultant alleges former employers failed to pay overtime wages

TYLER — A consultant is suing an oilfield services business, alleging violation of workers compensation acts in failing to pay overtime.

Billy Graham filed a lawsuit Sept. 22 in the Tyler Division of the Eastern District of Texas against Oilfield Service LLC and Jim Bob Bowman, alleging violation of the Fair Labor Standards Act.

According to the complaint, Graham regularly worked more than 40 hours a week as a consultant for Oilfield Services between December 2011 and October 2015 but was only paid on a day-rate basis. The suit says he was not paid the premium rate of time and half for hours worked more than 40 hour per week. 

The plaintiff alleges the defendants disregarded his federally protected rights by failing to properly compensate him for work performed.

Graham seeks trial by jury, judgment for an amount equal to his unpaid overtime wages, liquidated damages, prejudgment interest, attorney fees and court costs and all relief the court deems just. He is represented by attorneys Josef F. Buenker and Vijay A. Pattisapu of Houston.
