GALVESTON — A power company is is suing a Dickinson homeowner and tree trimmer, alleging their negligence led to the destruction of a primary conductor.
Texas-New Mexico Power Company filed a lawsuit Sept. 27 in Galveston County District Court against
Melissa Morris and Shawn Johnson,
alleging violation of the Texas Health and Safety Code.
According to the complaint, on Dec. 23, 2015, Texas-New Mexico Power suffered financial damages when a cut tree limb fell on its primary conductor, costing $5,415.70. The plaintiff alleges Morris negligently hired Johnson, who was unlicensed, unbonded and uninsured, to perform landscaping work on her Dickinson property. The lawsuit states Johnson failed to exercise reasonable care to avoid damage to the plaintiff's equipment.
Texas-New Mexico Power seeks trial by jury, judgment, individually or collectively, damages of at least $5,415.70, and all other relief to which the plaintiff is justly entitled. It is represented by attorney Jeff Haas of Donato, Minx, Brown & Pool PC in Houston.
