MARSHALL — A Morris County man is suing Daingerfield and a city police officer, alleging assault, battery and false imprisonment.
Barry Royal filed a lawsuit Oct. 4, in the Marshall Division of the Eastern District of Texas against City of Daingerfield and Brandon Fulcher alleging that the government entity and police officer violated the Civil Rights Act.
According to the complaint, on Oct. 4, 2014, Royal a 44-year-old black man, was deprived of his liberty and his right to be free from an unlawful search and seizure by Fulcher. The plaintiff alleges the defendants unlawfully seized, detained and arrested him without probable cause to believe that he had committed a crime. The suit also alleges assault and battery.
Royal seeks trial by jury, compensatory damages, punitive damages, attorney fees, costs of suit and all other appropriate relief. He is represented by attorney Gerald J. Smith Sr. of Law Office of G. J. Smith Sr. PLLC in Arlington.
