General contractor alleges Alvin company did not live up to contract

GALVESTON — A general contractor is suing an Alvin company, alleging the defendants' contract breach cost the plaintiff more than $123,000. 

Pinnacle Construction Industries Inc. filed a lawsuit Oct. 20 in Galveston County District Court against ACSC LLC and Patrick Sims, alleging failure to perform contractual obligations.

According to the complaint, as a result of the defendants' actions, Pinnacle Construction has suffered monetary damages of $123,404.08 and other special and consequential damages that have yet to be determined. 

The plaintiff alleges the defendants provided substandard and insufficient concrete and paving services that are not fit for its intended use and sought an additional amount greater than the agreed-upon contract price.

Pinnacle Construction seeks trial by jury, monetary relief between $100,000 and $200,00, judgment in excess of the minimum jurisdictional limits of the court, plus pre- and post-judgment interest, attorney fees, costs of court and all other relief.
