Contractor alleges Galveston couple owes nearly $61,000

GALVESTON — A Houston contractor is suing a Galveston couple, alleging,violation of Prompt Payment Act in failing to pay nearly $61,000.

US Construction Services LLC filed a lawsuit Nov. 1 in Galveston County District Court against Charles Montgomery and Marsha Montgomery, alleging they breached their agreement by failing to pay for services. 

According to the complaint, on Jan. 28, 2015, US Construction was contracted by the Montgomerys to perform construction work and repair services on their Galveston property for an amount of $60,969.29. The plaintiff alleges the defendants have failed and refused to pay for services and labor rendered.

US Construction Services seeks trial by jury, actual damages for not less than $60,969.29, exemplary damages, pre- and post-judgment interest, costs of suit, attorney fees and all other relief. It is represented by attorneys John J. Patout, Jr. and Martin C. Law of Patout & Shaw PLLC in Stafford.
