HOUSTON — A Houston man is suing Stein Mart, alleging violation of workers compensation acts in failing to pay proper overtime.
Bryan Broussard Jr. filed a lawsuit Nov. 3 in the Houston Division of the Southern District of Texas against Stein Mart, Inc. alleging violation of the Fair Labor Standards Act.
According to the complaint, Broussard regularly worked as an assistant store manager more than 40 hours a week at Stein Mart stores in Austin, Kingwood and San Antonio between September 2011 to May 2014. The suit says Broussard was not paid proper compensation at the rate of at least time and a half his hourly rate for all hours worked in excess of 40 per week as required by FLSA.
The plaintiff alleges Stein Mart classified him as exempt from overtime pay requirements, failed to keep accurate time records and failed to pay Broussard's overtime premium compensation.
Broussard seeks trial by jury, unpaid wages and liquidated damages, pre- and post-judgment interest, attorney fees and costs of action, plus all other proper relief.
