Customer blames Home Depot for fall, injuries

HOUSTON — A Harris County man is suing a local Home Depot store, alleging its negligence caused the plaintiff to suffer injuries.

Charles Scott filed a lawsuit Nov. 3 in Harris County District Court against Home Depot USA Inc.,  alleging the retail store operator failed to protect its patrons.

According to the complaint, in fall 2014, Scott was a patron at the Home Depot store in Harris County. While shopping, the suit says, Scott slipped and fell near the checkout area.

The lawsuit states the fall caused serious injuries to Scott's body, resulting in ongoing pain and suffering. The plaintiff alleges Home Depot failed to make the property reasonably safe and failed to adequately warn Scott of the existence of the dangerous condition.

Scott seeks trial by jury, actual and exemplary damages, pre- and post-judgment interest, costs of court, attorney fees and all relief to which he is entitled. He is represented by attorney David N. Harvey of Harvey & Associates PLLC in Houston.
