Health care professional alleges staffing agency, officers violated wage laws

HOUSTON — A Houston woman is suing a staffing agency and its officers, alleging violation of workers compensation acts in failing to pay proper wages.

Araceli Mendoza filed a complaint on Nov. 14, in the Houston Division of the Southern District of Texas against Certified EMS Inc., doing business as CPNS Staffing, doing business as CPNS Resources, Gasat Serrano and Godson Uchena Kanu, alleging they violated the Fair Labor Standards Act.

According to the complaint, during the three years preceding the lawsuit, Mendoza regularly worked more than 40 hours per week but is paid the same hourly rate for all hours worked. 

The plaintiff alleges the defendants mis-classified her as contract employee and failed to pay overtime wages for overtime hours worked at a rate of one and one-half times her regular rate as required by FLSA.

Mendoza seeks trial by jury, judgment, jointly and severally, for damages in the full amount of her unpaid overtime compensation, liquidated damages, attorney fees, costs and expenses, pre- and post-judgment interest and all other just relief.
