Customer accuses Toyota of design defects in crash

GALVESTON — A Galveston man is suing Toyota, alleging design and manufacturing defects.

Noel Kenneth Nelson filed a lawsuit Nov. 29 in Galveston County District Court against Toyota Motors Corporation and Toyota Motor Sales USA,   alleging the defendants failed to design a Lexus in conformity with its specifications.

According to the complaint, on May 9, Nelson was severely injured when the 2006 Lexus he bought from Toyota struck a concrete driveway and rolled over. 

The plaintiff alleges Toyota negligently designed and manufactured the vehicle's rollover protection structure (ROPS) and failed to provide adequate warnings regarding the rollover crash-worthiness of its ROPS. The suit says because the Lexus' structure was weak and dangerous, the vehicle was not crash-worthy. 

Nelson seeks trial by jury, damages according to the evidence of at least $75,000, costs of court and all other equitable relief. He is represented by attorney Robert E. Ammons of The Ammons Law Firm LLP in Houston.
