HOUSTON — A Harris County man is suing a Houston recycling company, alleging violation of workers compensation acts in not paying overtime.
J.C. Poullard Jr. filed a class action complaint, individually and on behalf of all others similarly situated, Dec. 1, in the Houston Division of the Southern District of Texas against Western Recyclers, Inc. doing business as American Recycler, alleging violation of the Fair Labor Standards Act.
According to the complaint, Poullard regularly worked more than 40 hours per week as a route driver for American Recycler between 2009 and October 2016, without receiving overtime compensation at a rate not less than one and one-half times his regular rate of pay as required by FLSA.
The plaintiff alleges American Recycler failed and refused to properly compensate him for all hours worked in excess of 40 per week and failed to maintain accurate time and pay records.
Poullard seeks trial by jury, an order allowing this case to proceed as a collective action, all unpaid overtime wages, liquidated damages, attorney fees and costs, pre- and post-judgment interest and such other and further relief. He is represented by attorneys Melissa Moore and Curt Hesse of Moore & Associates in Houston.
