Manager accuses Subway restaurant franchise owner of discrimination

HOUSTON — A former restaurant manager is suing a Subway restaurant franchise owner, alleging gender and pregnancy discrimination and wrongful discharge.

Brendel Dupree filed a complaint Dec. 7 in the Houston Division of the Southern District of Texas against GSB Services LLC (operating as Subway) alleging violation of the Texas Commission on Human Rights Act.

According to the complaint, during her pregnancy in February 2016, Dupree was not allowed to take temporary leave and was demoted from her position. On June 21, 2016, she was terminated from her employment, the suit says. 

The plaintiff alleges the defendant failed to provide reasonable accommodations, had discriminated against her due to her pregnancy and retaliated and terminated her employment for filing a charge of discrimination with the EEOC.

Dupree seeks trial by jury, compensatory damages, reinstatement of lost benefits, exemplary damages, attorney fees, costs of court, pre- and post-judgment interest and all other proper relief. She is represented by attorney DaSean A. Jones of Houston.
