Estate executor alleges bank breached agreement

GALVESTON — An estate executor is suing a Galveston bank, alleging breach of agreement and seeking up to $100,000. 

Bartley B. Hood of Santa Fe, as executor of the estate of Steve Hood Sr. filed a complaint Dec. 9 in Galveston County District Court against HomeTown Bank NA, formerly known as Bank of Galveston NA, failure to perform its contractual obligations.

According to the complaint, the plaintiff alleges that, on March 13, 1984, Hood's father Steve Hood Sr., now deceased, purchased two certificates of deposit at Bank of Galveston, now known as HomeTown Bank, for $10,000, with interest to be paid at 9.5 percent per annum. 

The plaintiff's attempt to surrender the CDs for payment was denied, the suit says, because the defendant refused to disburse the funds to Bartley Hood and wrongfully exercised dominion or control over an estate's property.

Hood seeks trial by jury, monetary relief of up to $100,000, penalties, court costs, expenses, pre-judgment interest and attorney fees and all other equitable relief. He is represented by attorneys R. Talmadge Hammock and Kristin F. Munkittrick of Hammock Law Firm PLLC in Houston.
