GALVESTON — A Harris County woman is suing dozens of health care providers, alleging retaliation and violation of workers compensation acts in failing to pay overtime.
Tonya Wallace filed a class action lawsuit, individually and on behalf of all others similarly situated, filed a class action complaint Dec. 13 in the Galveston Division of the Southern District of Texas against
Cantex Continuing Care Network LLC, Alvin Health Care Center Ltd. Co., doing business as Laurel Court, et al,
alleging violation of the Fair Labor Standards Act.
According to the complaint, Wallace regularly work as a registered nurse in excess of 40 hours per week without being paid overtime as required by FLSA. The plaintiff alleges the defendants refused to properly compensate her for all hours worked more than 40 per week, failed to maintain accurate time and pay records and terminated her for complaining about not being paid for all hours worked.
Wallace seeks trial by jury, an order allowing this case to proceed as a collective action, all unpaid overtime wages, lost wages, liquidated damages, front pay in lieu of reinstatement, attorney fees, court costs and interest and all other just and proper relief. She is represented by attorneys Melissa Moore and Curt Hesse of Moore & Associates in Houston.
