Shopper alleges stool fell on her at Walmart and caused injuries

HOUSTON – A Walmart shopper alleges she was injured by a stool that fell off of an employee's cart.

Adina De Los Santos filed a complaint on Dec. 19 in the Harris County District Court against Wal-Mart Stores Inc., Wal-Mart East Inc. and Wal-Mart Stores Texas LLC alleging negligence.

According to the complaint, the plaintiff alleges that in March 15, 2015, she was an invitee at defendants' store at 12353 FM 1960 in Houston and was checking out at the customer service station when an employee moved a cart and caused a bar stool to fall from the cart and strike her. She alleges the incident caused her to sustain severe injuries that resulted in pain and suffering, mental anguish and loss of earning capacity. The plaintiff holds Wal-Mart Stores Inc., Wal-Mart East Inc. and Wal-Mart Stores Texas LLC responsible because the defendants allegedly negligently allowed the defective and dangerous condition to exist on the premises and failed to correct the dangerous condition.

The plaintiff requests a trial by jury and seeks monetary relief of over $200,000 but not more than $1 million and all other just and proper relief. She is represented by Jason J. Ruen of and Brantley Sasseen in Houston.
