HOUSTON — A former employee is suing a provider of offshore platform and drilling rigs, alleging violation of workers compensation acts in failing to pay proper overtime.
Sherman Sicard of Sevier County, Utah,, individually and on behalf of all others similarly situated filed a class action complaint Dec. 20 in the Houston Division of the Southern District of Texas against Nabors International Inc. alleging violation of the Fair Labor Standards Act.
According to the complaint, between March 2014 and April 2016, Sicard worked as a tool pusher at oil well sites in excess of 40 hours each week without receiving proper overtime compensation. The plaintiff alleges Nabors International mis-classified him as an independent contractor and failed to compensate him at one and one-half times his regular rate for each hour worked more than 40 per week as required by FLSA.
Sicard seeks trial by jury, unpaid overtime wages, liquidated damages, attorney fees, court costs and expenses, pre- and post-judgment interest and all other equitable relief. He is represented by attorney Don J. Foty of Kennedy Hodges LLP in Houston.
