Two workers accuses joint employers of failure to pay overtime

HOUSTON — Two Texas men are suing joint energy-related employers, alleging violation of workers compensation acts in failing to pay overtime.

Tony Hickson and Larry Villa, individually and on behalf of all others similarly situated, filed a class action complaint Dec. 27 in the Houston Division of the Southern District of Texas against Keane Group Holdings, LLC, Keane Frac TX LLC, Keane Frac LP, Keane Frac GP LLC and Keane Frac ND LLC, alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiffs regularly worked more than 40 hours per week without receiving proper overtime compensation from the defendants. The plaintiffs allege despite regularly working more than 40 hours per week, the defendants paid them with a base salary, regardless of the number of hours the plaintiffs worked, in violation of FLSA, and failed to keep accurate records.

Hickson and Villa seek trial by jury, designation as representatives of the Pennsylvania class and counsel of record as class counsel, all unpaid overtime wages, liquidated damages, attorney fees and court costs and all proper relief. They are represented by attorneys Richard J. (Rex) Burch of Bruckner Burch PLLC in Houston, and by Joseph A. Fitapelli and Armando A. Ortiz of Fitapelli & Schaffer LLP in New York.
