Project manager alleges employers failed to pay overtime

HOUSTON — A Harris County man is suing his former employers, alleging violation of workers compensation acts in failing to pay overtime.

James O'Malley filed a complaint Jan. 26 in the Houston Division of the Southern District of Texas against Continental Superior Management Group GP LLC, ABC Associated Builders et al, alleging they violated the Fair Labor Standards Act.

According to the complaint, during some of O'Malley's work weeks with the defendants on road and highway projects, he worked in excess of 40 hours per week without receiving proper overtime compensation. The plaintiff alleges the defendants failed to pay an overtime premium at a rate of one and one-half times his regular hourly rate for each hour worked over 40 as required by FLSA.

O'Malley seeks trial by jury, judgment, jointly and severally, unpaid overtime wages, liquidated damages, pre- and post-judgment interest, attorney fees, court costs and all other equitable relief.
