Consumer accuses truck dealers of fraud

GALVESTON — A Michigan man is suing truck dealers, alleging breach of express warranty.

Jeremiah Pick of Kalamazoo, Michigan, filed a complaint Jan. 27 in Galveston County District Court against Texas Truck Sales, Michael Wayne Gillaspia Jr. and Trevor Wayne Gillaspia, alleging they intentionally violated the Texas Deceptive Trade Practices Act.

According to the complaint, on June 15, 2016, Pick transferred the full purchase price of $10,316.82 for a used pickup truck, plus a shipping cost of $648.99 to the defendants. When the truck was delivered, the suit says, Pick immediately noticed the vehicle had sustained substantial water damage. 

The suit says Pick suffered economic damages, mental anguish and expenses. The plaintiff alleges the defendants negligently represented that the truck was in excellent condition, needed no repairs and had a clean Carfax report.

Pick seeks trial by jury, monetary relief between $100,000 and $200,000 and all other just and proper relief. He is represented by attorney Dana Karni of Karni Law Firm PC in Houston.
