MARSHALL — A Cherokee County man is suing a rehabilitation and nursing center, alleging age discrimination and violation of workers compensation acts.
John Stallings of Jacksonville, Texas, filed a complaint Feb. 8 in the Marshall Division of the Eastern District of Texas against Concord Healthcare Group LLC, doing business as Gardendale Rehabilitation and Nursing Center, alleging violation of the Age Discrimination in Employment Act and the Fair Labor Standards Act.
According to the complaint, Stallings, due to his age, suffered discriminatory practices that deprived him of equal employment opportunities. The suit says Stallings, who began working for Gardendale in 2006, has suffered lost wages and fringe benefits, mental anguish and inconvenience.
The plaintiff alleges the defendant discriminated against him by failing to promote and transfer him to a more convenient shift because of his age and by intentionally failing to pay the overtime hours he worked.
Stallings seeks trial by jury, damages of $250,000, attorney fees and court costs and all other proper relief. He is represented by attorney Bob Whitehurst of Whitehurst & Whitehurst in Tyler.
