Worker accuses maintenance corporation of discrimination

MARSHALL — A Cass County man is suing a maintenance company, alleging failure to uphold Americans with Disabilities Act regulations.

Burnis James filed a complaint Feb. 8 in the Marshall Division of the Eastern District of Texas against Complete Facilities Maintenance Inc., doing business as Servicemasters Facilities Maintenance, alleging violation of the Texas Labor Code.

According to the complaint, as a result of James'  termination, he has suffered lost wages and benefits, mental anguish, pain and suffering, inconvenience and loss of enjoyment of life. 

The plaintiff alleges the defendant refused to honor his work restrictions imposed by his doctor after James suffered a head injury at work Dec.14, 2015, refused to accommodate his physical limitations and retaliated and by terminated him for engaging in protected activities.

James seeks trial by jury, compensatory damages, litigation expenses and all other proper relief. He is represented by attorney William S. Hommel, Jr. of Hommel Law Firm in Tyler.
