Abraham Watkins law firm hit with $1M breach of contract suit

HOUSTON – The self-proclaimed “oldest personal injury firm in Texas” was recently sued by a company seeking up to $1 million in damages for breach of contract.

Rainbow International Restoration & Cleaning filed suit against Abraham, Watkins, Nichols, Sorrels & Friends on Feb. 16 in Harris County District Court.

Barton Bennett, National Water and National Flood Services were also named as defendants.

According to the lawsuit, AW contracted with Rainbow to remove water and mud from the firm’s historic office building, which it completed.

However, apparently as a result of a dispute with its insurance carrier, AW has yet to pay Rainbow half of the money owed.

“AW has failed to pay plaintiff over $166,000 still due and owing under the contract,” the suit states. “In turn, Plaintiff has been unable to pay its subcontractors.”

In addition to breach of contract, the suit accuses the firm of unjust enrichment and alleges negligence against the other defendants for making representations to AW that Rainbow had charged excessive rates and extended the necessary work period.
