AMARILLO – Last month, three hail lawsuits, two of which were brought through Mostyn Law, went to trial in Potter County. All three cases ended in defense verdicts for State Farm Lloyds.
For the past two years, the Record has reported on State Farm’s aggressive stance toward mass storm litigation against it, with the insurer defeating multiple hails suits at trial and securing summary judgment wins in countless more.
The controversy of Texas trial lawyers, such as Houston attorney Steve Mostyn, drumming up mass litigation following hailstorms began in 2012 in Hidalgo County.
The state legislature is currently laboring to pass a bill aimed at ending the apparent abuse.
State Farm’s most current wins came in three separate hail suits filed in Potter County District Court.
Two of the three hail suits, the Mostyn Law ones, sought up to $1 million in damages. And all three were filed around two years after a May 28, 2013 hailstorm swept through the area.
For example, plaintiff Guillermo Lopez-Dimas claims State Farm did not adequately reimburse him for damages caused by the May 2013 storm, but did not file suit against the insurer until June 18, 2015.
At trial, the juries were asked if State Farm failed to comply with the terms of its insurance policy with the plaintiffs, to which jurors answered: “No,” according to court records.
