Pumper foreman accuses former employer of age discrimination

MARSHALL — A Kilgore man is suing his former employer, alleging violation of his civil rights.

Royce Ashberry filed a complaint Feb. 16 in the Marshall Division of the Eastern District of Texas against Breitburn Management Company LLC, alleging violation of the Age Discrimination in Employment Act.

According to the complaint, Ashberry, 70, was subjected to discriminatory practices, was deprived of employment opportunities and was terminated July 21, 2016, which caused him to sustain financial losses and mental anguish. The plaintiff alleges Breitburn Management suspended him in mid-July 2016, fired him about one week later and the replaced with him with a younger employee.

Ashberry seeks trial by jury, compensatory and punitive damages, reinstatement or front pay, attorney fees, court costs and interest and all other just and proper relief. He is represented by attorney Wade A. Forsman of Sulphur Springs.
