Couple alleges roofing contractors breached contract

HOUSTON — A Houston couple is suing roofing contractors, alleging breach of contract and unjust enrichment.

Junuz and Gordana Babic filed a complaint March 14 in Harris County District Court against A.C. Prestige Restoration Services LLC and Anthony Castilleja, alleging violation of the Texas Deceptive Trade Practices Act.

According to the complaint, on Dec. 13, 2015, the Babics entered into a roofing repair services contract to be performed by defendants. After weeks of no meaningful progress, the suit says, the Babics informed the defendants that they they no longer wished to proceed with the project and requested refund of their deposit of $4,910.67. 

To date, no refund has been received by plaintiffs, the lawsuit states. The plaintiffs allege the defendants failed to honor their obligations as promised by failing and refusing to send the refund check for the amount, minus $1,600 cancellation fees.

The Babics seek trial by jury, actual and punitive damages of $9,821.34, pre- and post-judgment interest, costs of court, attorney fees and all other equitable relief. They are represented by attorneys John J. Patout Jr. and Martin C. Law of Patout & Shaw PLLC in Stafford.
