Employee alleges pharmacy failed to pay proper wages

LUFKIN — A Lubbock County pharmacist is suing a pharmaceutical group, alleging failure to compensate for overtime work.

Stanley Drake filed a complaint March 13 in the Lufkin Division of the Eastern District of Texas against Best Med, Inc. and Priority Prescription Group, Inc. alleging violation of the Fair Labor Standards Act.

According to the complaint, between December 2013 and December 2015, Drake worked as an hourly employee for the defendants, regularly working overtime hours.

The suit says Drake was not compensated for hours worked in excess of 40 hours per week because the defendants failed to pay one and one-half times his regular rate of pay for each overtime hour worked as required by FLSA.

Drake seeks trial by jury, damages, attorney fees, costs, pre- and post-judgment interest and all other proper relief. He is represented by attorney David G. Langenfeld of Leichter Law Firm in Austin.
