Security guard allges agency failed to pay overtime

HOUSTON — A Harris County security guard has filed a class action lawsuit against a security business, alleging violation of workers compensation acts.

Johnny Garcia, individually and on behalf of all others similarly situated filed a complaint, March 17 in the Houston Division of the Southern District of Texas against Lake County Security Patrol Officer Inc., fornerly known as Lake County Patrol Inc., alleging violation of the Fair Labor Standards Act.

According to the complaint, Garcia regularly worked for Lake County Security for more than 40 hours per week without being paid at the rate of one and one-half times his regular rate for hours exceeding 40 hours per week. 

The plaintiff alleges the defendant required him to work more than 40 hours per week without paying the required overtime compensation as mandated by FLSA.

Garcia seeks trial by jury, unpaid overtime wages, liquidated damages, plus interest, attorney fees, court costs, and expenses and all other equitable relief. He is represented by attorney Charles M.R. Vethan of The Vethan Law Firm PC in Houston.
