Parents blame day care facility operators for son's injuries

HOUSTON — Two Harris County parents are suing day care facility operators, alleging their negligence caused injuries to their son.

Joel and Jayme Durrwachter, individually and as next friends for John Doe, a minor, filed a complaint March 29, in Harris County District Court against Learning Care Group Inc. and La Petite Academy Inc., alleging breach of duty to provide a safe environment.

According to the complaint, on Nov. 11, 2016, the plaintiffs' son, John Doe, was playing with an unsecured, large, wooden toy kitchen in the middle of the classroom when the entire kitchen fell on top of him, crushing the bones in his middle finger into multiple fragments. 

The suit says five months afterward, his fingers remains under the care of a pediatric hand specialist. The plaintiffs allege the defendants failed to properly secure the indoor play equipment to prevent tipping and/or overturning and failed to provide adequate supervision to the children in the classroom.

The Durrwachters seek a trial by jury, monetary relief of more than $1 million and all other equitable relief. They are represented by attorney Nataliya K. Tipton of Attorney Brian White & Associates PC in Houston.
