Parents blame dog, property owners for pet's attack on child

GALVESTON — A Galveston County couple is suing a Texas City property owner and tenant, alleging negligence led to a dog attacking their son. 

Michelle McElroy and Juan Martinez, individually and as next friend of John Doe, filed a complaint April 4 in Galveston County District Court against PN Real Estate LL and Dustin McCain, alleging PN Real Estate negligently failed to monitor its leased property for the safety of guests.

According to the complaint, on Dec. 9, 2016, the plaintiffs were in a social gathering at the home of McCain, a tenant at PN Real Estate's property in Texas City. While the plaintiffs' minor son was petting McCain's pit bull, the suit says, the dog viciously attacked the child about his face/head area. 

The lawsuit states the boy was seriously injured and required immediate medical attention. The plaintiffs allege PN Real Estate negligently allowed a vicious and dangerous animal to live on its property.

McElroy and Martinez seek trial by jury, monetary relief between $200,000 and $1 million and all other equitable relief. They are represented by attorney Tom Gehring of Law Office of Tom Gehring PC in Austin.
