HOUSTON – A consumer alleges he purchased a defective all-terrain vehicle that caused him injuries.

Dusty Page filed a complaint on April 28 in the Harris County District Court against the defendants alleging Texas Motor Sports Inc., doing business as Texas Power Sports and Maxtrade LLC, alleging products liability and negligence.

According to the complaint, on April 29, 2015, plaintiff purchased a Coolster Mountopz-110 that was manufactured by defendant Maxtrade at defendant Texas Motor Sports in Houston. Shortly after purchase, the plaintiff alleges he drove it to the gas station and when he attempted to brake, the brakes failed and caused him to crash.

The plaintiff holds Texas Motor Sports Inc. and Maxtrade LLC responsible because the defendants allegedly negligently manufactured and sold the defective and unsafe Coolster.

The plaintiff requests a trial by jury and seeks actual damages, plus interest, costs of court and such other relief to which plaintiff is justly entitled. He is represented by Jorge L. Gomez of Gomez Law Firm in Houston.
