Tenant accuses Galveston County landlord of breach of contract

GALVESTON — A tenant is suing its Galveston County landlord, alleging breach of a commercial lease agreement.

Zimmerman Law Firm LLP filed a complaint May 1 in Galveston County District Court against Heritage Erectors Development Inc.,  alleging the landlord failed to perform its contractual obligations.

According to the complaint, in August 2016, as a result of the noise made by the construction of a nearby office space and the children's activities on the new day care center, Zimmerman Law Firm suffered business interruption, loss of revenues and additional cost for securing an alternative office. 

The plaintiff alleges the defendant refused to provide rent abatement or a sound barrier or any soundproofing materials to prevent the noise, or at least reduce it to acceptable levels.

Zimmerman Law Firm seeks trial by jury, damages, attorney fees, costs of suit and all other equitable relief. It is represented by attorney Mark A. White of Law Office of Mark A. White in Houston.
